These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “Customer”) and CKing LLC, a Colorado, USA limited liability company doing business as Furniture Design Assets (“Company,” “we,” “us,” or “our”), governing your access to and use of furnituredesignassets.com (the “Site”) and the digital products, files, and services made available through it (collectively, the “Services”).
By accessing the Site, creating an account, or purchasing or downloading any product from us, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Site.
1. Eligibility and Accounts
You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase products from the Site. By using the Site, you represent that you meet this requirement and that you are using the Site for lawful, professional, or personal design purposes.
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@furnituredesignassets.com if you suspect unauthorized use of your account.
2. Nature of Our Products
We sell downloadable digital 3D furniture and interior design assets (“Digital Products”), including individual models, model bundles, and curated room/scene sets, in formats that may include OBJ, FBX, and other industry-standard 3D file formats, along with associated textures and reference materials as described on each product listing. Every Digital Product offered on the Site is an original design created in-house or produced by designers commissioned by us under written agreements that assign full ownership and originality rights to CKing LLC. We do not resell, redistribute, or relist third-party stock 3D assets as our own original work.
Digital Products are delivered electronically. No physical goods are shipped.
3. Licensing of Digital Products
Purchase of a Digital Product grants you a limited, non-exclusive, non-transferable, revocable license to use the file(s) in accordance with the license tier purchased, as stated on the applicable product listing at the time of purchase. We generally offer the following license tiers, described in further detail on individual product pages:
Personal License — for individual, non-commercial visualization and personal project use only. Not licensed for use in client-facing, commercial, or resold work.
Commercial License — permits use of the model in commercial interior design, architectural visualization, marketing, and client deliverables, including renders, presentations, and print or digital marketing materials produced for paying clients.
Extended Commercial License — includes all Commercial License rights plus additional usage rights specified on the listing, which may include use in real-time/game engine applications, virtual reality experiences, or inclusion in larger commercial software products, as specified per product.
Regardless of license tier, you may not: (a) resell, sublicense, rent, lease, or redistribute the source files (in original or modified form) as a standalone digital asset, on any marketplace, asset store, or file-sharing service; (b) claim authorship of the underlying 3D design; (c) use the files to train machine learning or generative AI models without our prior written consent; or (d) use the files in any way that infringes the rights of others or violates applicable law.
We reserve the right to revoke a license, without refund, in the event of a material breach of these licensing terms.
4. Intellectual Property
All Digital Products, along with the Site’s design, text, graphics, logos, and other content, are the property of CKing LLC or its licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws. Except for the limited license granted under Section 3, nothing in these Terms transfers ownership of any intellectual property to you.
5. Pricing and Payment
All prices are listed in U.S. Dollars (USD) and are subject to change without notice; the price in effect at the time you complete a purchase applies to that transaction. We are responsible for determining and remitting any taxes owed on our own income; where applicable, sales tax or VAT may be added at checkout in accordance with the laws of your jurisdiction. Payments are processed through third-party payment processors; we do not store your full payment card details on our servers.
6. Refunds and Cancellations
Because our products are downloadable digital goods delivered instantly upon purchase, refunds are handled in accordance with our Refund Policy, which is incorporated into these Terms by reference.
7. Acceptable Use
You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to gain unauthorized access to our systems or another user’s account; (c) upload or transmit viruses, malware, or other harmful code; (d) scrape, crawl, or use automated means to extract data from the Site without our prior written consent; or (e) interfere with or disrupt the integrity or performance of the Site.
8. Third-Party Links and Services
The Site may contain links to third-party websites or services (including payment processors) that are not owned or controlled by us. We are not responsible for the content, privacy practices, or terms of any third-party site. Your use of third-party services is governed by their own terms and policies.
9. Disclaimer of Warranties
The Site and all Digital Products are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that Digital Products will be compatible with every software application or hardware configuration.
10. Limitation of Liability
To the fullest extent permitted by law, in no event shall CKing LLC, its owners, officers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site or any Digital Product, even if advised of the possibility of such damages. Our total aggregate liability arising out of or relating to these Terms or your purchase of any Digital Product shall not exceed the amount you paid to us for the specific product giving rise to the claim in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless CKing LLC and its officers, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, your misuse of a Digital Product, or your violation of any applicable law or third-party right.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services that cannot be resolved informally shall be subject to the exclusive jurisdiction of the state and federal courts located in Colorado, and you consent to personal jurisdiction in those courts. Before initiating formal proceedings, both parties agree to attempt in good faith to resolve any dispute by contacting support@furnituredesignassets.com.
13. Changes to These Terms
We may revise these Terms from time to time. The updated version will be indicated by an updated “Last updated” date, and changes take effect as soon as they are posted. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
14. Termination
We may suspend or terminate your access to the Site or any account at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, us, or third parties. Provisions of these Terms that by their nature should survive termination (including Sections 3–4 and 9–12) will survive.
15. Severability and Entire Agreement
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and CKing LLC regarding the Site and Digital Products.
